Frequently Asked Questions

Please reach us at inquiry@leyvalawoffice.com if you cannot find an answer to your question.

The length of time it takes to get a divorce can vary depending on factors such as the complexity of the case and whether or not there are disputes that need to be resolved. In general, an uncontested divorce can take as little as a few months, while a contested divorce can take a year or more.

Shared parental responsibility is when both parents discuss and mutually agree on all major issues (i.e., medical, education, religion) in regard to their child's well being. Sole parental responsibility means that one parent solely makes the decision on all major issues (i.e., medical, education, religion) in regard to their child’s well being.

A prenuptial agreement is a legal document that outlines how assets and debts will be divided in the event of a divorce or separation. It can also address issues such as spousal support and inheritance rights. Prenuptial agreements are becoming more common, especially among couples who have significant assets or businesses.

Florida is a no-fault state meaning you do not need a reason to file for divorce. All the law requires is (1) You are a resident of the State of Florida for a period of six months prior to filing of your Petition for Dissolution of Marriage; and (2) The marriage is irretrievably broken.

Child support is calculated based on statutory guidelines that takes into account factors such as each parent's income, the number of children, the child's health insurance premiums, daycare/after care expenses and the timesharing arrangements between the parents.
